TERMS AND CONDITIONS

These Terms and Conditions govern your use of the Bacride taxi booking application. They outline the rights and responsibilities of both users and the Company, including rules for account usage, bookings, payments, cancellations, and limitations of liability. By accessing or using Bacride, you agree to comply with these Terms.

INTERPRETATION AND DEFINITIONS

Interpretation: The words with initial capital letters used in these Terms have specific meanings as described in this section. Whenever these capitalized words appear, they shall be interpreted according to these definitions unless explicitly stated otherwise.

Definitions: For the purposes of these Terms and Conditions:

• Application means the mobile software program provided by the Company and downloaded by You on any electronic device, named Bacride, which allows passengers and drivers to interact for transportation services.

• Application Store means the digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) from which the Application can be downloaded. This also includes any future official platforms authorized by the Company.

• Affiliate means an entity that controls, is controlled by, or is under common control with a party. This includes subsidiaries, parent companies, and other related entities involved in the operation of the Service.

• Country refers to: India, where the Service is legally operational and regulated.

• Company (referred to as either "the Company", "We", "Us" or "Our") refers to Bacride, operated by [Insert your registered legal entity here], responsible for providing, maintaining, and managing the Service.

• Device means any electronic device capable of accessing the Service, such as a smartphone, tablet, or computer, regardless of operating system.

• Service refers to the Bacride taxi booking application and any associated services, features, or updates provided by the Company.

• Terms and Conditions (Terms) mean this agreement that forms the entire understanding between You and the Company regarding Your use of the Service.

• You means the individual accessing or using the Service, whether as a passenger or driver, or the legal entity on behalf of which such individual is accessing or using the Service.

ACKNOWLEDGMENT

These Terms govern Your access to and use of Bacride and constitute a binding legal agreement between You and the Company. By downloading, accessing, or using the Service, You explicitly agree to be bound by these Terms. If You do not agree with any part of these Terms, You must not access or use the Service.

You represent and warrant that You are at least 18 years old and legally capable of entering into binding agreements. Bacride strictly prohibits access and use by individuals under 18 years of age. Your use of Bacride is also subject to our Privacy Policy, which governs how We collect, store, and utilize Your personal data and ensures compliance with applicable data protection laws.

USE OF THE SERVICE

• For Passengers: You may use Bacride to request rides from available drivers, view estimated fares, track ride status, and make payments. You acknowledge that all ride details, including estimated time and distance, are indicative and may vary based on real-time circumstances.

• For Drivers: Drivers may use Bacride to accept ride requests, communicate with passengers, and receive payments for completed rides. Drivers must comply with all applicable laws, maintain valid licenses, and ensure vehicles are in safe operating condition.

• Company Role: The Company provides a technology platform and does not directly provide transportation services. All rides are facilitated by independent drivers who operate as separate entities responsible for passenger safety and service quality.

• User Responsibility: You agree to provide accurate and complete information when creating and maintaining Your account. You are responsible for ensuring that Your account details, including contact information, payment methods, and vehicle information (for drivers), are current and correct.

• Prohibited Activities: Misuse of the Service, including fraudulent activity, harassment, unsafe conduct, or attempts to manipulate fares, is strictly prohibited. The Company reserves the right to investigate and take appropriate action against violators.

BOOKINGS, PAYMENTS, AND CANCELLATIONS

• Fare Calculation: Fares are determined based on distance, estimated time, traffic conditions, demand, and applicable fees, including tolls or surcharges.

• Payment Processing: All payments are processed through secure third-party payment gateways. You agree to pay all amounts due for rides and services through these systems.

• Cancellation Policy: If You cancel a ride after a driver has been assigned, cancellation fees may apply. The fees are designed to compensate drivers for lost time and operational costs.

• Refunds: Refunds, if eligible, will be issued according to the Company’s refund policy. The Company reserves the right to review each case individually before issuing any refund.

TERMINATION

The Company reserves the right to suspend or terminate Your account immediately, without prior notice, if:

• You violate these Terms or any applicable law.

• You engage in fraudulent, abusive, or harmful activities.

• Your actions endanger other users, drivers, or third parties.

Upon termination, Your access to the Service will cease immediately. Termination does not affect Your obligations to pay any outstanding amounts or liabilities accrued prior to termination.

LIMITATION OF LIABILITY

Bacride functions solely as a technology platform connecting passengers and drivers. The Company is not responsible for the actions, behavior, or safety of drivers or passengers.

• We are not liable for delays, ride cancellations, personal injury, loss, or any indirect, incidental, or consequential damages arising from use of the Service.

• Our maximum liability to You, regardless of the cause, shall not exceed the total amount You paid for the Service or ₹7,500 (approx. USD 100), whichever is lower.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal proceedings relating to the Terms shall be brought exclusively in courts located within India.

DISPUTE RESOLUTION

If You have a concern or dispute regarding the Service, You agree to first contact Us to attempt an informal resolution. We will make reasonable efforts to resolve disputes in good faith. If a resolution cannot be reached, disputes may be submitted to arbitration or the courts in accordance with Indian law.

SEVERABILITY AND WAIVER

• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to be fully effective.

• Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in the future.

CHANGES TO THESE TERMS

The Company may modify or update these Terms at any time. Material changes will be communicated through the Application or by email. By continuing to use the Service after modifications, You agree to be bound by the updated Terms. It is Your responsibility to review the Terms periodically to stay informed of changes.
